WOONSOCKET â€“ A 32-year-old city woman was raped repeatedly by her ex-boyfriend and forced to eat food on which he had urinated â€“ all in the presence of her 4-year-old son, police say.
Reinaldo Diaz, 34, was ordered held without bail Monday at the Adult Correctional Institutions on three counts of forcible rape, including an act of sodomy; two counts of domestic assault; and other charges. He was arrested Friday afternoon after another of the victimâ€™s children, a daughter, called the police about a quarrel at home.
Police said Diaz was subject to an active court order to keep away from the victim at the time he allegedly raped her. That prompted police to also charge him with violating a no contact order.
Diaz was also wanted on an active warrant or failure to appear in court for a hearing on charges that he assaulted the same woman in November 2012, according to Detective Jamie Paone, spokeswoman for the Woonsocket police.
Diaz allegedly raped the victim three times the night before her daughter contacted the police. Paone said the girl was not home when the attacks took place, but arrived sometime after they had taken place. Paone said the girl is a legal minor but did not give her age.
Police said the incidents happened at an apartment on Rathbun Street, but they redacted the address from reports. The woman described one of the attacks as an act of sodomy, but police did not release any other details about the alleged sexual assaults.
When Officers Joseph A. Zinni and Enrique Sosa arrived, they said the victim answered the door. One of her ankles was visibly swollen, they reported, and the woman appeared shaken.
When they asked who called the police, the woman dashed into the hallway and closed the door behind her, saying she feared Diaz would kill her daughter if he found out the answer.
â€śWhen we notified her that we were going in to detain him she ran outside onto the porch crouching down in fear,â€ť one of the officers reported.
Officers said Diaz became â€śaggressiveâ€ť when they took him into custody, but they did not elaborate. As he was being led to a police cruiser he allegedly yelled out to the victim that she would never see her son again.
The woman told police she was sodomized in front of her child, and also forced to eat food soiled by Diaz while her son watched. No other incidents of sexual assault were mentioned in paperwork released by the police, but Paone said the woman was attacked three times between midnight and 6 a.m. on Friday.
A departmentâ€™s forensics team was sent to the victimâ€™s apartment to collect evidence after Diaz was arrested. The victim was taken to Landmark Medical Center, where doctors processed a rape kit for evidence and treated her injuries, including the swollen ankle, according to Paone. She was discharged after being treated.
Diaz was ordered held without bail at the ACI following an initial appearance in District Court Monday. He is due back in court for a review hearing on Nov. 29, according to the judiciaryâ€™s web site.
Other than the 2012 domestic assault and Fridayâ€™s arrested, Diaz has had only one prior contact with the police in Rhode Island. In June, the North Smithfield police charged him with shoplifting and obstructing. He later pleaded no contest to the shoplifting charge. The charge was filed for a year, a form of probation, and the other charge was withdrawn.
